In real estate, a buyer is generally required to provide some “earnest money” when making an offer on a house. The function of earnest money is to serve as evidence of “good-faith intentions to perform under the contract.” However, in some states, the term earnest money has specific meaning. For example: In some states if the deposit is called earnest money, “the buyer may abandon the contract at no penalty, except forfeiture of the deposit, and/or the seller can abandon the contract by returning the buyers deposit.”
